Terms of Service

1. Acceptance of Terms

By accessing or using Command Center, you agree to these Terms of Service and any policies referenced here. If you use the service for a company or organization, you represent that you are authorized to accept these terms on its behalf.

2. Service Description

Command Center is an early-access business operating workspace designed to help users organize priorities, follow-up, content, projects, decisions, and recurring processes. Features may change during early access and may include integrations with third-party systems you authorize, software components you install on your own device to extend the service to your local accounts and systems, and AI-enabled or automated processing described elsewhere in these Terms.

3. User Responsibility and Review

You are responsible for reviewing, approving, and deciding whether to use any drafts, suggestions, summaries, automations, reminders, reports, or outputs created through the service. Where a feature composes a message or other communication intended for a third party, that communication is not sent unless you individually review and approve it. Command Center is a support tool and does not replace professional judgment, legal advice, tax advice, accounting advice, financial advice, medical advice, or other licensed professional advice.

4. AI-Enabled and Automated Support

Some service features may use AI-enabled, rules-based, automated, or third-party processing to organize information and prepare suggested outputs. These outputs may be incomplete, inaccurate, delayed, or unsuitable for a particular purpose. You agree not to rely on any output without independent review and approval by an authorized human decision-maker. Some AI-enabled processing, including message composition for outreach features, runs on our servers using an AI provider account provisioned for your account and metered against your plan's usage allowance; if usage exceeds that allowance, affected features may be limited or paused until the allowance renews or you increase it. Usage is displayed to you and is visible to us for billing, support, and service-operation purposes.

5. Connected Systems and Permissions

If you connect email, calendar, document, financial, messaging, CRM, Microsoft, Google, QuickBooks, or other systems, you authorize Triumph Business Solutions and its service providers to access, process, transmit, and store the information reasonably necessary to provide the requested functionality. You are responsible for ensuring you have the rights and permissions needed to connect those systems. Where a feature is provided through software you install on your own device, the same authorization and responsibility applies to any system or account that software accesses on your device.

6. Locally-Installed Automation Agent

Certain features, including outreach messaging, are provided in part through a software agent that you install and run on your own computer. That agent operates using your own device and your own logged-in sessions on third-party platforms, such as LinkedIn, Alignable, or Facebook — Triumph Business Solutions does not receive, hold, or store your login credentials for those platforms. The agent reads information from pages and conversations you are already logged into and transmits limited information to Command Center to support drafting and record-keeping. It takes no action on a third-party platform on your behalf until you individually approve a specific message in Command Center, at which point it uses your existing browser session on your device to carry out that approved action. The agent updates itself automatically each time it runs, so you are always running the version currently distributed by Command Center. You are solely responsible for your use of each third-party platform, including compliance with that platform's own terms of service and keeping your account there in good standing. We may suspend or revoke a device's access to the service at any time, including for suspected misuse, security risk, or violation of these Terms.

7. No Warranties

The service is provided on an as-is and as-available basis. To the fullest extent permitted by law, TBS, Triumph Business Solutions, Triumph Coaching Group LLC, their owners, employees, contractors, agents, representatives, affiliates, and service providers disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

8. Limitation of Liability

To the fullest extent permitted by law, TBS, Triumph Business Solutions, Triumph Coaching Group LLC, and their owners, employees, contractors, agents, representatives, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages; lost revenue; lost data; business interruption; reputational harm; third-party claims; or decisions made from use of the service or its outputs, even if advised of the possibility of such damages.

9. Indemnification and Hold Harmless

You agree to defend, indemnify, and hold harmless TBS, Triumph Business Solutions, Triumph Coaching Group LLC, and their owners, employees, contractors, agents, representatives, affiliates, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the service, your connected systems, your data, your instructions, your use or reliance on outputs, your violation of these Terms, or your violation of any law or third-party right.

10. User Content and Data

You retain ownership of information you submit, connect, or authorize the service to process. You grant us the rights necessary to host, process, transmit, display, and use that information to provide, secure, maintain, and improve the service and related support. Where you provide feedback on an AI-generated draft, we may use that feedback to improve the service: feedback about your own preferences and voice is applied to your account, while feedback indicating an error in the underlying approach or methodology may be reviewed by Triumph Business Solutions staff — including review of the associated draft and message content — and used to improve the shared prompts and methodology used across all customers' accounts. Where a connected or locally-installed feature collects or generates information about a third party, such as a prospect or contact, you are solely responsible for the accuracy and lawfulness of that information, for what you choose to submit or share with AI-enabled processing on their behalf, and for that individual's own public profile or platform content, which we do not verify.

11. Acceptable Use

You may not use the service for unlawful activity, to infringe rights, to submit malicious code, to bypass security, to scrape or overload systems, to generate deceptive content, to process data you are not authorized to provide, or to use any connected or locally-installed feature in a manner that violates the terms of service of the third-party platform it operates on. You are responsible for your own compliance with each third-party platform's terms.

12. Third-Party Services

The service may depend on third-party platforms, APIs, identity providers, models, hosting providers, and integrations. We are not responsible for third-party services, outages, terms, policy changes, data handling, or outputs.

13. Early Access Changes

During early access, features, limits, availability, plans, pricing, and support levels may change. We may suspend, limit, or discontinue features at any time.

14. Termination

We may suspend or terminate access if we believe continued use creates risk, violates these Terms, violates law, creates security concerns, or harms another person or system.

15. Connecting a Client's Accounting System

If you connect a client's or another business's accounting system, such as QuickBooks, to the service, you represent and warrant that you have that business's authorization to connect its accounting system and to allow Command Center and its service providers to access, process, and store the information reasonably necessary to provide the requested functionality on your behalf. Connection tokens for a client's accounting system are stored under the same protections described for other connected systems in these Terms. You are responsible for maintaining that authorization for as long as the connection remains active and for promptly disconnecting the system if it lapses. Before enabling this capability, you will be asked to acknowledge this section; a record of that acknowledgement is kept as described in the Privacy Policy.
